Terms of Use for the Their First Words plugin

1. Agreement
These Terms of Use (“Terms”) govern your use of the Their First Words plugin for ChatGPT (the “Plugin”), provided by Their First Words LLC, a California limited liability company (“we,” “us,” “our”). By connecting or using the Plugin you agree to these Terms and to the Privacy Notice for the Their First Words plugin. If you do not agree, do not use the Plugin.
The Terms of Service for the Their First Words app cover the mobile app, not the Plugin.
2. What the plugin is
The Plugin lets ChatGPT search the Their First Words library on your behalf: picture word cards and everyday phrases in eight languages with recordings, phonics words and sentences, artworks, place stories, conversation lines, and number and letter cards. It can play recordings, gather cards into a set and give you a link to a print-ready page. It has no account and stores nothing you make.
3. Who can use it
The Plugin is for adults: parents, grandparents, caregivers, teachers and tutors preparing an activity for a young child. You must be at least 18 years old, or the age of legal majority where you live, to use it. It is not designed for use by children, and you agree not to present it to a child as something to use on their own.
4. License to use the content
The pictures, recordings, words, phrases, stories and printable pages the Plugin provides (the “Content”) are owned by us or used under licence. We grant you a personal, non-exclusive, non-transferable licence to view, play and print the Content for your own home, classroom or tutoring use with the children in your care.
You may not sell the Content, redistribute it as a collection, extract or download it in bulk, remove credit lines, use it to build another product or dataset, or pass it off as your own. Printables are for the children you teach or care for, not for resale.
5. Acceptable use
You agree not to interfere with the Plugin or its server, to send it automated or unusually heavy traffic, to try to get around its limits or signed links, or to use it for anything unlawful. We may limit or refuse requests that look automated or abusive.
6. Artworks and credits
The artworks in the library are in the public domain or used under a Creative Commons licence, as stated in each work’s credit line. The credit line is shown with every artwork picture and printed with it; keep it with the picture if you share a printout.
7. Free of charge
The Plugin is free. It sells nothing, has no subscription and no in-plugin purchases. Our mobile apps are separate products with their own terms; using the Plugin neither requires nor unlocks anything in them.
8. Privacy
How the Plugin handles information is described in the Privacy Notice for the Their First Words plugin. In short: no account, no profiles, nothing stored about you or a child.
9. ChatGPT
ChatGPT is operated by OpenAI under its own terms and privacy policy. We do not control ChatGPT, what it says about the Content, or what it keeps about your conversations. Answers ChatGPT composes from the Content are ChatGPT’s output, not ours.
10. Educational disclaimer
The Content is general early-learning material. It is not advice about any particular child’s development, speech or language. For concerns about a child, talk to the child’s doctor or a speech and language professional.
11. Disclaimers
The Plugin and the Content are provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement and uninterrupted or error-free operation. We may change, suspend or withdraw the Plugin or any Content at any time.
12. Limitation of liability
To the fullest extent permitted by law, Their First Words LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising from your use of the Plugin, and our total liability for any claim relating to the Plugin will not exceed one hundred US dollars (US$100). Some jurisdictions do not allow these limits, so some may not apply to you.
13. Changes and termination
We may update these Terms; the date at the top shows the current version. Continuing to use the Plugin after a change means you accept it. We may end or limit your use of the Plugin at any time if you break these Terms. You can stop using it at any time by disconnecting it in ChatGPT.
14. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Sacramento County, California, unless the law where you live gives you the right to bring it elsewhere.
